Terms and Conditions

1. Contractual Nature
These Terms and Conditions (the “Terms”) constitute a binding legal agreement between you (“User” or “you”) and Velociti fitness, a company duly incorporated and licensed under the laws of the United Arab Emirates with commercial license no. [●] (“Company,” “we,” “us”).
By downloading, installing, accessing, or using the mobile application Velociti fitness (the “App”), you acknowledge that you have read, understood, and agreed to be legally bound by these Terms and the Privacy Policy.


2. Eligibility
Use of the App is restricted to natural persons who:
   a) are at least eighteen (18) years of age (or have obtained parental/guardian consent if younger);
   b) have full legal capacity to enter into binding contracts under UAE law; and
   c) are not barred from using the App under any applicable law or regulation.


3. User Account
   3.1. You shall provide complete, accurate, and current information.
   3.2. You are solely responsible for safeguarding your access credentials.
   3.3. Any misuse, misrepresentation, or fraudulent information entitles the Company to suspend or terminate your account without liability.


4. Fees and Payment
   4.1. Entry into certain challenges may require payment of a registration fee as displayed within the App.
   4.2. Payments are processed exclusively by licensed UAE payment service providers; the Company neither receives nor holds user funds.
   4.3. Refund Policy: Users may request a refund of the registration fee if they cancel their account before the challenge begins or within [X] days of payment (whichever is earlier). Refunds are processed to the original payment method where technically feasible. Once a challenge has started or has been accessed by the User, fees are non-refundable except if the Company cancels the challenge.


5. Challenges and Rewards
Each challenge’s objective, duration, and completion criteria are published within the App. Rewards are earned strictly by meeting the published performance or completion standards; there is no element of chance or gambling.
The Company may require objective proof of completion (data, measurements, photos, or other evidence) and may disqualify any User engaged in manipulation or fraud.


6. Health Disclaimer
Participation is voluntary and at your own risk. The App does not provide medical advice. You are solely responsible for determining your fitness to participate. Seek medical clearance before undertaking any physical activity.


7. Intellectual Property
All intellectual property rights in the App, including but not limited to software code, design, text, graphics, trademarks, trade names, and logos, are owned by or licensed to the Company and protected under UAE Federal Law No. 38 of 2021 on Copyright and Neighboring Rights and other applicable laws.
No rights are granted to you other than a limited, revocable, non-transferable license to use the App.


8. Data Protection
Personal data is collected and processed pursuant to Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data and as further detailed in the Privacy Policy. By using the App, you consent to such processing.


9. Limitation of Liability
To the maximum extent permitted by law, the Company disclaims any liability for indirect, consequential, punitive, or special damages.
The Company’s aggregate liability for any claim shall not exceed the total fees paid by the User for the relevant challenge.


10. Indemnity
You agree to indemnify and hold harmless the Company, its directors, officers, and employees from any third-party claims arising out of your breach of these Terms or misuse of the App.


11. Termination
We may, with immediate effect, suspend or terminate your access if you breach these Terms, misuse the App, or act unlawfully.


12. Governing Law & Jurisdiction
These Terms are governed by the laws of the United Arab Emirates. The courts of Dubai (unless otherwise specified by the Company) shall have exclusive jurisdiction.


13. No Financial or Banking Services
The App and the Company do not provide banking, money remittance, stored value, investment, or other regulated financial services.

All payments are processed solely through duly licensed third-party payment service providers in the UAE.
The Company does not issue electronic money, operate a wallet, hold user balances, or engage in any activity requiring authorization by the Central Bank of the UAE or any other financial regulator.


14. Amendments
We may update these Terms by posting a new version on the App. Continued use after changes means you accept the revised Terms.
